EXOTICS RALLY

DEFINITIONS

For the purposes of this document, "Exotics Rally" shall refer to the Internet site "ExoticsRally.com" (also known as "Exotics Rally, Inc."), and its owners and administrators. "You" shall refer to any person accessing Exotics Rally, whether authorized or unauthorized.

SCOPE

By accessing Exotics Rally, you indicate your agreement to be bound by the terms of this agreement. If you do not agree to these terms, you may not access Exotics Rally. This agreement shall be the entirety of the agreement between you and Exotics Rally, and shall not be amended save in writing, signed by both parties.

APPLICABLE LAW

Exotics Rally is located in the county of Nassau in the state of New York, and is intended for use by authorized users only. Exotics Rally makes no claim that any materials or services offered by Exotics Rally and its authorized users are appropriate for use in other locations. By accessing Exotics Rally, you do so at your own initiative, and you assume full responsibility for compliance with your local laws. You further agree that the laws of the county of Nassau and the state of New York shall govern all transactions and interactions with Exotics Rally and its authorized users.

DISCLAIMER OF LIABILITY

Exotics Rally assumes no liability for the actions of its users, whether authorized or unauthorized. By accessing Exotics Rally, you agree that under no circumstances shall Exotics Rally or its administrators be liable for any damages arising from your use of Exotics Rally, or any materials or software made available on Exotics Rally. In no event shall Exotics Rally's total liability to you for all damages or losses exceed the amount paid by you, if any, to Exotics Rally for accessing its services.

Exotics Rally assumes no responsibility for the integrity of data stored on Exotics Rally facilities. Each user of Exotics Rally is responsible for maintaining their own backups of their data, including (but not limited to) user data files, user-installed software, and electronic mail. In the event of judgement against Exotics Rally for liability arising from the actions of any of its users, whether authorized or unauthorized, that user agrees to assume full responsibility for the settlement of that judgement.

PRIVACY NOTICE

For the purposes of the Electronic Communications Privacy Act, Exotics Rally is not to be considered a secure communications medium. The Exotics Rally administrators reserve the right to monitor all communications which may pass through, originate from, or terminate at Exotics Rally.

SEPARABILITY

If any provision of this agreement is held to be unlawful, void, or otherwise unenforceable, then that provision shall be considered separable from this agreement, and the remainder of the agreement shall remain in effect. This document is the entire agreement between you and Exotics Rally, and shall not be modified save in writing, signed by both you and Exotics Rally.

Exotics Rally reserves the right to refuse or terminate service to anyone, for any reason, at any time.

DISALLOWED USAGE

Use of Exotics Rally to engage in illegal activity or to engage in mass-mailings or news postings inappropriate to the newsgroup in question is strictly forbidden. Use of Exotics Rally equipment by any person not authorized by Exotics Rally to send mail, news, or other electronic communication shall be considered a theft of services and will be prosecuted to the fullest possible extent of the law. Attempts to gain unauthorized access to Exotics Rally or to cause harm to the operations of Exotics Rally or its authorized users will be reported to the Federal Bureau of Investigations for criminal prosecution, without exception or warning from Exotics Rally.

The list of users hosted on Exotics Rally is considered to be a Trade Secret by the owners of Exotics Rally, Inc. Any attempt to reverse-engineer or otherwise determine the identities and user names of Exotics Rally's users shall be considered an act of industrial espionage, and will be prosecuted as such.

Unsolicited commercial email ("spam") is not allowed to be sent to Exotics Rally users. Persons violating this restriction will be prosecuted under all applicable criminal and civil statutes.

In the event of legal action against you by Exotics Rally resulting in judgement against you, you agree to pay in full all reasonable costs incurred by Exotics Rally for the legal action in question, in addition to any judgements or penalties awarded by the court to Exotics Rally.

All content, text, forum posts, photos, videos, likenesses, logos, emails, sound files and other recordings, assets, files, and downloads-- collectively "The Content" on the Exotics Rally web site is wholly owned and CopyRight by Exotics Rally.

You may not collect, re-post, publish, quote, cite, distribute, copy, alter, sell, archive or otherwise manipulate The Content without the express written permission of Exotics Rally.
